AN ORDINANCE AUTHORIZING A PARTIAL TAX EXEMPTION AGREEMENT WITH EMIL J. CONFORTH, PURSUANT TO N.J.S.A. 40A:21-1 et seq.

WHEREAS, Emil J. Conforth (“Conforth”) has applied for a partial tax exemption for the construction of a 580 square foot addition, with a cost of $33,000, on property located at Block 17, Lot 14.01, in the Township of Wantage;

WHEREAS, N.J.S.A. 40A:21-1, et seq., as well as Chapter 22 of the General Ordinances of the Township of Wantage allow the partial tax exemption requested by Conforth.

WHEREAS, the Wantage Township Economic Development Commission has favorably reviewed Conforth's application and the Wantage Township Committee is approving the partial exemption contingent upon Conforth entering into a tax exemption agreement as provided for by N.J.S.A. 40A:21-10.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Wantage, County of Sussex and State of New Jersey, as follows:

Section 1.
The partial tax exemption request of Conforth is hereby approved contingent upon the parties entering into a tax agreement (Exhibit "A") pursuant to N.J.S.A. 40A:21-10. The exemption is further contingent upon Conforth obtaining the requisite planning and/or zoning board approvals and complying with all conditions set forth in such approvals as well as any requirements of the Wantage Township Construction Office. The partial tax exemption is further contingent upon Conforth paying all applicable property taxes during the construction period as well as any and all nonexempt taxes during the tax agreement period. Finally, this approval is specifically contingent upon Conforth and/or tenants, successors or assigns, including in any advertising that the business is located in Wantage, New Jersey.

Section 2.
The Mayor and Clerk are authorized to sign the Agreement on behalf of the Township.

Section 3.
All ordinances or parts of ordinances or resolutions inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.

Section 4.
This ordinance shall take effect after publication and passage according to law.

NOTICE is given that this ordinance amendment was introduced and passed upon first reading at a meeting of the Mayor and Township Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on the 17th day of March, 2005. It will be further considered for final passage with the proposed ordinance after public hearing at a meeting of the Mayor and Township Committee to be held in the Wantage Township Municipal Building, 888 Route 23, Wantage, New Jersey 07461, on March 31, 2005, at 8:00 o'clock P.M., and copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
