Ordinance No. 2007-15

AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WANTAGE TO ADD FEES RELATED TO COAH ADMINISTRATIVE COSTS IN CHAPTER XXI,
§21-1 ET SEQ. THE “WANTAGE TOWNSHIP FEES” CHAPTER

BE IT ORDAINED by the Mayor and Township Committee of the Township of Wantage, County of Sussex, State of New Jersey that the following addition is made to Chapter XXI, “Wantage Township Fees” Section as follows:

 SECTION 1.  A new Section, §21-18 “COAH Administrative Fees” is hereby adopted:

21-18  COAH ADMINISTRATIVE FEES
     
            a.  Developers are required to pay appropriate fees pursuant to the Council of Affordable Housing (“COAH”) rules, and as set forth in Chapter XXVII “Affordable Housing”, in the Township of Wantage Ordinance.

            b.  Administrative Fee – Once any COAH fee has been paid by an applicant, if the return of fees is later sought, Wantage Township shall charge a fee of $200 for the administrative costs incurred related to the Township’s COAH and affordable housing obligations.

SECTION 2.  Severability.  If any provision of this ordinance or the application of this ordinance to any person or circumstances is held invalid, the remainder of this ordinance shall not be affected and shall remain in full force and effect. 

SECTION 3.  Repealer.  All ordinances or parts of ordinances or resolutions inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety. 

SECTION 4.  Effective Date.  This ordinance shall take effect after publication and passage according to law.

NOTICE

TAKE NOTICE that the above entitled ordinance was introduced at a regular meeting of the Mayor and Township Committee of the Township of Wantage, County of Sussex, New Jersey, held on  October 11, 2007, and will be considered for final passage after public hearing at a regular meeting of the Mayor and Township Committee to be held on October 25, 2007 at 8:00 p.m. in the Municipal Building, Route 23, Wantage, New Jersey.  During the preceding week, copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
