Ordinance #2003-02

WHEREAS, the Wantage Township Committee previously adopted Ordinance #2002-20 establishing traffic control regulations for the Northfields development;

WHEREAS, the New Jersey Department of Transportation has requested that the Township amend its ordinance to delete any reference to Chapter 7 (Traffic) in the Township’s Code Book as Chapter 7 had not been previously approved by the NJDOT;

WHEREAS, the Wantage Township Engineer has provided a revised certification of approval, along with additional information requested by the DOT. The Township Engineer has also certified the proposed traffic control regulations for the Northfields development comply with the manual of Uniform Traffic Control Devices for Streets and Highways as adopted by the New Jersey Commissioner of Transportation, as required by N.J.S.A. 39:4-8;

WHEREAS, N.J.S.A. 39:4-8 authorizes the Township to adopt traffic control regulations, subject to final approval by the New Jersey Department of Transportation; and,
WHEREAS, the Wantage Township Committee believes it is in the best interest of the Township to adopt the traffic regulations.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Wantage, that the following traffic control regulations are adopted for the Northfields development:

Section 1. Through Street. Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described are hereby designated as through streets. Stop Signs shall be installed on the near right side of each intersecting roadway.

Section 2. Stop Intersection. Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described are designated as Stop Intersections. Stop Signs shall be installed as provided therein.

Section 3. Speed Limits.
A. The speed limits for both directions of traffic along the streets or parts thereof described below are established at the rate of speed indicated.
B. Regulatory and warning signs shall be erected and maintained to effect the below designated speed limits.

Section 4. In accordance with N.J.S.A. 39:4-8(b), a certified copy of this ordinance shall be transmitted by the Township Clerk to the Commissioner of the Department of Transportation within 30 days of adoption along with a copy of the Engineer’s certification and statement of the reasons for the Engineer’s decision along with the map showing the location of the traffic control devices.

Section 5. Severability. If any provision of this ordinance or the application of this ordinance to any person or circumstances is held invalid, the remainder of this ordinance shall not be affected and shall remain in full force and effect.

Section 6. Repealer. All ordinances or parts of ordinances or resolutions inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.

Section 7. Effective Date. This ordinance shall take effect after publication and passage according to law.

NOTICE is given that this ordinance amendment was introduced and passed upon first reading at a meeting of the Mayor and Township Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on February 27, 2003. It will be further considered for final passage with the proposed ordinance after public hearing at a meeting of the Mayor and Township Committee to be held in the Wantage Township Municipal Building, 888 Route 23, Wantage, New Jersey 07461, on March 27, 2003, at 8:00 o'clock P.M., and copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
