2004 Proposed Ordinances of Wantage Township

Ordinance # 2004-15

“AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN LANDS IN THE TOWNSHIP OF WANTAGE TO BE SOLD AT PRIVATE SALE IN ACCORDANCE WITH N.J.S.A. 40A:12-13(b)(1).”

WHEREAS, the Mayor and Committee of the Township of Wantage have determined that municipally owned land known as Block 2 Lot 2, as shown on the Township Tax Map, is no longer needed for municipal purposes and as such shall be sold at private sale to the State of New Jersey in accordance with N.J.S.A. 40A:12-13(b)(1); and

WHEREAS, the Local Lands and Building Law, N.J.S.A. 40A:12-1, et seq., authorizes the sale by municipalities of any real property, capital improvement or personal property no longer needed for public use.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Committee of the Township of Wantage that municipally owned land known as Block 2 Lot 2, as shown on the Township tax Map, containing approximately 19.592 acres of land, as set forth in the attached Statement of Just Compensation which is part of the attached agreement, shall be sold by private sale to the State of New Jersey. The property is unimproved and is being sold by the Township ''as is".

BE IT FURTHER ORDAINED that in accordance with N.J.S.A. 40A:12-13(b)(1), the property is being privately offered for sale without the necessity of public bidding to the State of New Jersey.

BE IT FURTHER ORDAINED the following terms and conditions shall apply:

  1. The Township shall enter into a written Contract with State of New Jersey in a form prepared by the New Jersey Department of Environmental Protection. The Mayor and Clerk are hereby authorized to execute the Contract on behalf of the Township.
  2. The title being conveyed shall be by sufficient Deed of Warranty conveying to the State of New Jersey marketable title to the property. The State of New Jersey will bear the cost of the title search, preparation of closing documents, all transfer tax and recording fees.

This Ordinance shall take effect after publication and passage according to law.

NOTICE
TAKE NOTICE that the above entitled ordinance was introduced and passed upon first reading at a meeting of the Mayor and Township Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on August 12, 2004. It will be further considered for final passage after public hearing at a meeting of the Mayor and Township Committee to be held in the Wantage Township Municipal Building, 888 Route 23, Wantage, New Jersey 07461, on September 9, 2004, at 8:00 o’clock P.M., and copies of the ordinance amendment will be made available at the Clerk’s Office in the Municipal Building to members of the general public.
