MINUTES OF THE WORKSHOP AND REGULAR MEETING OF THE MAYOR AND COMMITTEE OF THE TOWNSHIP OF WANTAGE, HELD AT THE WANTAGE TOWNSHIP MUNICIPAL BUILDING, 888 STATE HIGHWAY 23, WANTAGE, N.J. ON THE DATE OF JUNE 8, 2006

Mayor Jeffrey Parrott called the workshop session to order at 7:05 p.m., and requested the Clerk to call the roll. Upon roll call, the following members of the governing body were present: Mayor Parrott, Committee members DeBoer, Space. The following members were absent: None.
Also present: Township Attorney, Michael Garofalo; Township Planner, David Troast, Township Engineer, Harold Pellow; Township Land Use Board Chairman, Jim Smith, Township Planning Board Member and Secretary, Joanne Kanapinski.

Mayor Parrott stated, “This meeting is being held in compliance with the provisions of the Open Public Meetings Act, P.L. 1975, Chapter 231. It has been properly advertised and certified by the Clerk”.

Mayor Parrott led the assembly in the Salute to the Flag.

Mayor Parrott opened the meeting and Administrator, Jim Doherty suggested that the governing body consider entering into closed executive session, as the planned discussion affects existing litigation.

As there were members of the public present at the meeting, Mayor Parrott opened the meeting to the public rather than have the few residents wait until the end of the workshop session to voice their concerns. A resident asked that the growth share be explained in detail and Mayor Parrott explained that the growth share ordinance is on the agenda for the regular meeting and invited the residents to return at 8:00 p.m.

EXECUTIVE SESSION
Mr. Space made a motion to enter into executive session, as follows:
WHEREAS, the Open Public Meetings Act, P. L. 1975, Chapter 231 permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, this public body is of the opinion that such circumstances presently exist; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Committee of the Township of Wantage, that the public shall be excluded from discussion of the following matter involving pending litigation and attorney client privilege, BE IT FURTHER RESOLVED that Minutes will be kept on file in the municipal clerk’s office, and once the matter involving the confidentiality of the above no longer requires that confidentiality, then the minutes shall be made public.
Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

After meeting in closed executive session, Mayor Parrott declared the meeting reconvened into regular session.

Mayor Parrott opened the meeting to the public at this time, for any questions or comments involving the good and welfare of the community.

As there was no one who wished to come forward, Mayor Parrott closed the meeting to the public and returned to the regular order of business.

There being no other items for the consideration of the governing body at this time, Mr. Space moved to adjourn the workshop session. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None
Mayor Parrott declared this workshop session to be adjourned at 8:00 p.m.

Upon roll call, the following members of the governing body were present: Mayor Parrott, Committee members DeBoer, Space. The following members were absent: None. Also present: Township Attorney Michael Garofalo

Mayor Parrott stated, “This meeting is being held in compliance with the provisions of the Open Public Meetings Act, Public Laws 1975, Chapter 231. It has been properly noticed and posted to the public, and certified by the Clerk."

Mayor Parrott led the assembly in the Salute to the Flag.

CONSENT AGENDA
Mayor Parrott requested that the members of the Committee Review the Consent Agenda. There being no Committee member present wishing to comment on the proposed Consent Agenda, Mayor Parrott requested approval of the Consent Agenda.

RESOLUTIONS
Mr. Space moved to approve payment of bills for the meeting of June 8, 2006. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to approve liquor license renewals in Wantage Township for 2006-07. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to supporting proposed legislation in NJ State Assembly for Gang Deterrence. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to amend the existing 2006 Salary Resolution by including a $1400 stipend for Mike Flood, pro-rated for July through December, upon successful completion of Animal Control certification, in compliance with the requirements of the collective bargaining agreement between Union Local 911 and the Township of Wantage. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to authorize the Mayor and Clerk to submit an application for funding from the State of New Jersey Department of Transportation for Blair Road Improvements Section III. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to authorize refund $500 to Douglas Cestone for Developer Fee paid in error on Block 136 Lot 9. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to authorize refund of $500 to Bruce Morse for Developer Fee paid in error on Block 66 Lot 7&8. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Space moved to authorize municipal endorsements for final round of Farmland Preservation applications in Wantage Township for 2007 funding round. Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

ADMINISTRATOR’S REPORT
Mr. Doherty informed the Committee that the Municipal calendars will be mailed within the next week, and Wantage Township flags are now available for sale.

Mr. Doherty informed the Committee that the resolution for approval this evening gives renewal to all Wantage Township liquor license holders except W&I Inc (formerly Heater’s) and CT Productions (formerly Glenn Brook). W&I has been inactive for more than two consecutive full licensing terms, so the owner needs to get a special ruling from the State of NJ before the Township can renew that license; CT Productions needs to obtain a Tax Clearance Certificate from the NJ Division of Taxation before the Township can consider their renewal.

Mr. Doherty asked the Committee to review the attached proposal for amending the Township fee schedule which includes exemptions from building permit fees for non-profit organizations up to $400.

Mr. DeBoer, made a motion to introduce on first meeting ORDINANCE 2006-13 “AN ORDINANCE TO AMEND CHAPTER VII OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF WANTAGE, TO PROVIDE WAIVER OF BUILDING AND HOUSING FEES FOR ELIGIBLE CHARITABLE AND NONPROFIT ORGANIZATIONS AND DISABLED PERSONS”, final hearing set for June 29, 2006. Mr. Space seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Parrott asked that the July 13 meeting be moved to July 20, 2006. The Committee agreed by consensus, and asked Mr. Doherty to advertise the change.

Mr. Doherty asked the Committee to see the attached letter of request from Henry & Betsy Hopper, asking for return of $35 fee when their dog was taken into custody by the Township Animal Control Officer. Mr. Doherty informed the Committee that he does not endorse return of the fee. The Committee agreed by consensus not to refund fee, as the Sheriff’s Office attested to the fact that the animal was running at large when they arrived at the residence.

Mr. Doherty asked the Committee to see the letter dated May 24, 2006 from Richard Honig on behalf of Sussex South Associates regarding vacating Black Dirt Road. Mr. Doherty hopes to have input from Land Use Board and/or Harold Pellow on this matter for the Committee’s consideration at a future meeting.

ATTORNEY’S REPORT
Mayor Parrott requested Mr. Garofalo to give the Attorney’s Report. Mr. Garofalo informed the Committee that tax appeal hearings will be held from Tuesday through Friday of next week.

COMMITTEE REPORTS
Mayor Parrott informed the Committee that Art Jacobs and Diane Snure, Sussex/Wantage School Boards Members, have been working diligently to receive funds back from state, have redirected medical benefits, and are looking into alternate funding sources for completion of the needed roof repairs.

Mayor Parrott informed the Committee that he has been in contact with Richard Hehmeyer of the Trust for Public Land, to set up a meeting to discuss a possible purchase of lands located on Lower Unionville Road, through their group or other consortiums available for such funding purposes.

Mayor Parrott offered the Committee clarification of the exit tax he had discussed at a previous meeting for residents leaving the State of New Jersey.

NEW BUSINESS
Ordinance 2006-12: Growth Share Ordinance
General discussion took place regarding the introduction of this ordinance and subsequent review and analysis upon receiving input from the public. Mr. Doherty stated his understanding that it was the desire of the governing body to defeat the proposed ordinance 2006-12 as introduced, and then consider re-introduction of a revised draft of that ordinance.

Mr. Space made a motion to defeat ORDINANCE 2006-12 entitled “AN ORDINANCE AMENDING THE GROWTH SHARE ORDINANCE OF THE TOWNSHIP OF WANTAGE.” Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

Mr. Garofalo highlighted significant changes made to the original ordinance which led to the defeat. General discussion took place regarding the need for a growth ordinance and how to best accomplish this mandated COAH requirement.

Mr. DeBoer made a motion to introduce on first reading ORDINANCE 2006-12, entitled “AN ORDINANCE AMENDING THE GROWTH SHARE ORDINANCE OF THE TOWNSHIP OF WANTAGE.” Final hearing set for July 20, 2006. Mr. Space seconded the motion. Upon roll call,

APPROVAL OF MINUTES
Mr. Space made a motion to approve the minutes of the meeting of the Mayor and Committee of the Township of Wantage held on May 25, 2006 (regular and executive). Mr. DeBoer seconded the motion. Upon roll call, Ayes: DeBoer, Parrott, Space Nays: None Absent: None Abstain: None

OPEN PUBLIC SESSION
Mayor Parrott opened the meeting to the public at this time, for any questions or comments involving the good and welfare of the community.

Ed Caparuscio, Lake Neepaulin, expressed his unhappiness with the Committee’s decision to extend the effective date of the Growth Share Ordinance.

John Quinlan, resident and builder, Wantage Township, thanked the Committee for taking his comments under consideration.

Skip Ferguson, builder, Wantage Township, expressed his thoughts against forcing a builder to construction affordable housing units within their developments rather than pay for units to be built elsewhere.

As there was no one else who wished to come forward, Mayor Parrott closed the meeting to the public and returned to the regular order of business.

There being no other items for the consideration of the governing body at this time, Mr. DeBoer moved to adjourn the meeting. Mr. Space seconded the motion.
