  2006 Ordinaces of Wantage Township

Ordinance No. 2006-07

AN ORDINANCE TO AMEND CHAPTER 8-2 OF THE GENERAL ORDINANCES OF THE TOWNSHIP OF WANTAGE ENTITLED “PROPERTY MAINTENANCE CODE”

BE IT ORDAINED by the Township Committee of the Township of Wantage that Chapter 8-2 of the General Ordinances of the Township of Wantage, entitled “Property Maintenance Code” shall be and is hereby amended as follows:

Section 1.     Section 8-2.1 shall be amended to read as follows:

Adoption of Property Maintenance Code. That a certain document, three copies of which are on file in the Office of the Clerk of the Township of Wantage, being marked and designated as the International Property Maintenance Code as published by the International Code Council, Inc. be and is hereby adopted as the Property Maintenance Code of the Township of Wantage, in the County of Sussex, State of New Jersey;  for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted and part hereof, as if fully set out in this Section with the additions, insertions, deletions and changes as follows:
1. Section 101.1: Insert Township of Wantage

2. Section 107.2(4):  Insert a correction Order allowing 30 days for the repairs and improvements required to bring the dwelling unit or structure into compliance with the provisions of this Code.  The property owner may request an additional period of time, up to 30 days, if the property owner can show to the satisfaction of the Construction Official that the property owner cannot reasonably complete the necessary work within 30 days.

3. Section 111.1: Insert Wantage Township Property Maintenance Code Board of Appeals.  Add to the end of Section 111.1:  Any person filing an appeal shall pay the fee provided in Section 8-2.4.

4.Section 303.14: Insert May 1 to October 1.

5.Section 404.5: Table 404.5 shall be amended to provide that the minimum area requirements for 1 to 2 occupants shall be a living room of 120 square feet and a dining room of 80 square feet.

6. Section 602.3: Insert October 1 to April 15.

7.Section 602.4: Insert October 1 to April 15.

Section 2.  Severability.  If any provision of this ordinance or the application of this ordinance to any person or circumstances is held invalid, the remainder of this ordinance shall not be affected and shall remain in full force and effect. 

Section 3.  Repealer.  All ordinances or parts of ordinances or resolutions inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety. 

Section 4.  Effective Date.  This ordinance shall take effect after publication and passage according to law.

NOTICE
TAKE NOTICE that the above entitled ordinance was introduced at a regular meeting of the Mayor and Township Committee of the Township of Wantage, County of Sussex, New Jersey, held on March 9, 2006, and will be considered for final passage after public hearing at a regular meeting of the Mayor and Township Committee to be held on March 30, 2006 at 8:00 p.m. in the Municipal Building, Route 23, Wantage, New Jersey.  During the preceding week, copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
