Ordinance No. 2006-11

AN ORDINANCE REPEALING THE TOWNSHIP’S EXISTING SOIL EROSION AND SEDIMENT CONTROL ORDINANCES CONTAINED IN CHAPTER XVII OF THE TOWNSHIP’S GENERAL ORDINANCES AND TRANSFERRING THE RESPONSIBILITY FOR SOIL EROSION AND SEDIMENT CONTROL TO THE SUSSEX COUNTY SOIL CONSERVATION DISTRICT.

WHEREAS, the Wantage Township Committee has determined that it shall transfer responsibility for soil erosion and sediment control to the Sussex County Soil Conservation District; and

WHEREAS, it is the Township Committee’s decision to repeal the Township’s existing Soil Erosion and Sediment Control Ordinance, Chapter XVII.

NOW, THEREFORE, BE IT ORDAINED by the Wantage Township Committee, Sussex County, New Jersey:

Section 1. Wantage Township Ordinance Chapter XVII “Soil Erosion and Sediment Control” is repealed in its entirety.

Section 2. The responsibility for future soil erosion and sediment control responsibility shall be transferred to the Sussex County Soil Conservation District.

Section 3. Notwithstanding the foregoing, in the event there are any current applications pending before the Township of Wantage, they shall be processed under the existing Ordinance, unless such applications are transferred to the Sussex County Soil Conservation District.

Section 4. Severability. If any provision of this ordinance or the application of this ordinance to any person or circumstances is held invalid, the remainder of this ordinance shall not be affected and shall remain in full force and effect.

Section 5. Repealer. All ordinances or parts of ordinances or resolutions inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.

Section 6. Effective Date. This ordinance shall take effect after publication and passage according to law.

NOTICE
TAKE NOTICE that the above entitled ordinance was introduced at a regular meeting of the Mayor and Township Committee of the Township of Wantage, County of Sussex, New Jersey, held on March 9, 2006, and will be considered for final passage after public hearing at a regular meeting of the Mayor and Township Committee to be held on March 30, 2006 at 8:00 p.m. in the Municipal Building, Route 23, Wantage, New Jersey. During the preceding week, copies of the ordinance will be made available at the Clerk’s office in the Municipal Building to members of the general public.
