  2007 Ordinances of Wantage Township

Ordinance No. 2007-05

AN ORDINANCE TO AMEND CHAPTER XIII ZONING ORDINANCE OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WANTAGE

WHEREAS, the Land Use Board has recommended that the Residential Environs Zoning District (RE-5) be amended to ensure rational, safe and orderly development as envisioned in the Township Master Plan; and

WHEREAS, the Wantage Township Committee has determined that it is in the best interest of the health, safety and welfare of the Township to adopt this revision to the Zoning Ordinance;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Committee of the Township of Wantage, that Chapter XIII Zoning, Section 13-5.4, Building Height and Section 13-5.5, Area and Yard Requirements, of the General Ordinances of the Township of Wantage, shall be and is amended as follows:

Section 1. Section 13-5.4 shall be amended to read as follows:

No building in the RE-5 district shall exceed two stories or 35 feet in height, whichever is lesser, other than farm buildings, churches and hospitals and except as provided in subsection 13-13.16.

Section 2. Section 13-5.5.a.1.h shall be amended to read as follows:

(h) A minimum of 20,000 square feet of contiguous developable land, as defined herein, inside the building envelope of each lot. The single-family dwelling shall be constructed entirely within the contiguous developable land inside the building envelope.

Section 3. Section 13-5.5.b.1(h) shall be amended to read as follows:

(h) A minimum of 20,000 square feet of contiguous developable land, as defined herein, inside the building envelope of each lot. The single-family dwelling shall be constructed entirely within the contiguous developable land inside the building envelope.

Section 4. Section 13-5.5.c.1(i) shall be amended to read as follows:

(i) A minimum of 20,000 square feet of contiguous developable land, as defined herein, inside the building envelope of each lot. The single-family dwelling shall be constructed entirely within the contiguous developable land inside the building envelope.

Section 5. Should any section, paragraph, sentence, clause, or phrase of this Ordinance be declared unconstitutional or invalid for any reason, by a court of competent jurisdiction, such provision(s) shall be deemed severable, and the remaining portions of this Ordinance shall remain in full force and effect.

Section 6. All ordinances or parts of ordinances or resolutions that are inconsistent with the provisions of this Ordinance are repealed to the extent of such inconsistency.

Section 7. This Ordinance shall take effect after publication and passage according to law.

NOTICE is hereby given that the above ordinance was introduced and passed upon first reading at a meeting of the Mayor and Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on the 25th day of January 2007.  It will be further considered for final passage after public hearing at a meeting of the Mayor and Committee to be held in the Municipal Building, 888 Route 23 South, in the Township of Wantage, on February 22, 2007, at 8:00 P.M., and during the preceding week copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
