An Ordinance Amending Chapter 02: Section 2-10.8, Retiree Health Benefits, Authorizing and Directing the Payment of Premiums for Health Benefits After Retirement for Certain Employees
WHEREAS, the Township of Wantage, has elected to adopt the provisions of N.J.S.A. 52: 14-17.38 (Chapter 48) and adhere to the rules and regulations promulgated by the State Health Benefits Commission to implement the provisions of the State Health Benefits Plan; and
WHEREAS, N.J.S.A. 40A:10-23 authorizes a public employer, in its discretion, to assume the entire cost of health care coverage for its employees who have retired with a requisite number of years of service credit with the Public Employees Retirement System and requisite number of years of service with the public employer, as established by the employer and/or who have reached a certain age at the time of their retirement; and
WHEREAS, the Township understands that it may be required to provide the Division of Pensions and Benefits complete copies of all contracts, ordinances, and resolutions that detail post-retirement medical payment obligations needed to carry out the terms of this Ordinance.
NOW, THEREFORE BE IT ORDAINED, by the Township Committee of the Township of Wantage, County of Sussex, State of New Jersey, the Chapter xx of the Township Code is hereby amended to Establish Section 2-10.8, Retiree Health Benefits,
Section 2-10.8. Retiree Health Benefits,
- § Section 2-10.8a The Township of Wantage hereby authorizes payment of the entire cost of post-retirement medical benefits coverage for its employees who have reached 62 years of age and have retired after 30 consecutive years of service credit with the Township. The coverage shall extend to both the employee and his or her spouse until they each reach the age of 65 years old.
- § Section 2-10.8b In accordance with Chapter 78, P.L. 2011, (effective June 28, 2011) all Township employees receiving health benefits shall pay a contribution towards the cost of health benefits.
- § Section 2-10.8c Upon reaching the age of 65, the Township will reimburse Medicare costs for eligible employees up to two hundred fifty dollars ($250.00) per month with valid proof of payment for 15 years.
- § Section 2-10.8d Employees eligible for benefits conferred by this ordinance shall not be eligible for any other retiree health benefits including those set forth in Resolution §A-3 adopted November 30, 2006.
- § Section 2-10.8e The Township Administrator, and such other officials, employees, agents of the Township of Wantage are hereby authorized and directed to prepare and execute all necessary documents and perform all necessary acts to implement this ordinance.

SECTION 2: Ordinances, resolutions, regulations or parts of ordinances, resolutions, and regulations inconsistent herewith are hereby repealed to the extent of such inconsistencies.
SECTION 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by a court of competent jurisdiction, such a decision shall not affect the remaining portions of this Ordinance.
SECTION 4: This Ordinance shall take effect immediately upon final passage and publication in the manner according to law.

NOTICE is hereby given that the above ordinance was introduced and passed upon first reading at a meeting of the Mayor and Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on the 12th day of October, 2023. It will be further considered for final passage after public hearing at a meeting of the Mayor and Committee to be held in the Municipal Building, 888 Route 23 South, in the Township of Wantage, on October 26, 2023 at 7:00 P.M., and during the preceding week copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
