An Ordinance Amending the Wantage Township Zoning Ordinance by Amending the Zoning Designation and Zoning Map to Rezone Lots 1.01, 2.01, 2.02, 2.03 and 2.04 in Block 10 and Lots 4, 5, 5.01, 5.02, 7, and 24 and a portion of Lot 10 in Block 11 located at Blair Road, Route 23, and Cemetery Road from Various Zoning Districts to the Zoning District known as PCD Denoted as Planned Commercial Development Referenced in Section 13-9a of Chapter 13 (zoning).

WHEREAS the Planning Board of the Township of Wantage has completed its periodic general re-examination of the Master Plan of the township pursuant to N.J.S.A. 40:55D-89 of the Municipal Land Use Law; and

WHEREAS the Planning Board re-examined and amended the Master Plan on September 19, 2023, as a result of and as contained in that re-examination, the Planning Board has recommended that the Township Zoning Map be amended so as to rezone certain properties heretofore contained in one zoning district into another zoning district; and

WHEREAS the Township Committee of the Township of Wantage is in accord with and accepts those recommendations and desires to amend the Township Zoning Map and to amend Section 13-9A Planned Commercial Development, all as delineated herein above; and

WHEREAS N.J.S.A. 40:55D-63, as amended in 1995, declares that a notice of hearing on an amendment to the zoning ordinance proposing changes to the classification or boundaries of a zoning district is not required if such classification or boundary changes have been recommended to the Township Committee in a periodic general re-examination of the Master Plan by the Planning Board.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Wantage, in the County of Sussex and State of New Jersey that 1) the Zoning Map of the Township of Wantage is hereby amended to as to rezone Lots 1.01, 2.01, 2.02, 2.03 and 2.04 in Block 10 and lots 4, 5, 5.01, 5.02, 7 and 24 and a portion of Lot 10 in Block 11 from various zone to the PCD District (Section 13-9A).

Section I

  1. The Township of Wantage Zoning Map, as referenced in Section 13-3.2, is hereby amended to reflect the changes recited herein and such Zoning Map is attached hereto as Exhibit A to the Ordinance.
  2. This Ordinance hereby changes the zoning of certain properties from the various zones to the zoning district known as PCD, denoted as Planned Commercial Development Zone referenced in Section 13-9A of Chapter 13 (Land Use) of the Township Municipal Code. The properties being transferred to the PCD zoning district are identified as the following tax parcels contingent upon the perfection of the subdivision of current Block 11, Lot 10 and the merger of Block 10 Lot 24 with Lot 5.02:

  4. This Ordinance hereby changes the zoning of these properties for the following reason: Adding these parcels to the PCD zone would provide additional area to these already large parcels which would lend themselves even further to large scale planned development associated with the PCD zone. Adding Block 10, Lot 2.01, 2.02, 2.03 and 2.04, which are currently vacant and split zone between residential and District 5 zone and the Highway Commercial Zone would also support large scale development potential of adjacent properties.

Section II

If any part of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the ordinance..

Section III

Should any section, paragraph, sentence, or clause of this ordinance be declared unconstitutional or invalid for any reasons, the remaining portions of this ordinance shall not be affected thereby and shall remain in full force and effect and, to this end, the provisions of this ordinance are hereby declared severable.

Section IV

The within ordinance shall take effect in the time and manner provided by law and, if particular, the procedure delineated in the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.

NOTICE is hereby given that the above ordinance was introduced and passed upon first reading at a meeting of the Mayor and Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on the 26th day of October 2023. It will be further considered for final passage after public hearing at a meeting of the Mayor and Committee to be held in the Municipal Building, 888 Route 23 South, in the Township of Wantage, on November 12, 2023 at 7:00 P.M., and during the preceding week copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
