Transfer of property known and designated as block 117 lot 17 to Sussex County Habitat for Humanity

An ordinance authorizing the transfer of property known and designated as block 117 lot 17 on the official tax map of the Township of Wantage, County of Sussex, state of New Jersey to Sussex County Habitat for Humanity, a non-profit corporation of the state of New Jersey, pursuant to n.j.s.a. 40a:12-21(j).

WHEREAS, the Township of Wantage is the owner of Property known and designated as Block 117 Lot 17 on the Official Tax Map of the Township of Wantage, and commonly known as 392 Route 565 (the "Property"); and

WHEREAS, the Township of Wantage has determined that it has no current public use or purpose for the Property; and

WHEREAS, N.J.S.A. 40A:12-21(j) authorizes the sale of real property, for a nominal consideration, to a non-profit corporation for the purpose of building or rehabilitating residential property for resale, provided that any profits on the resale of the property shall be applied by the non-profit organization to the costs of acquiring and rehabilitating other residential property in the need of rehabilitation owned by the County or Municipality, or _________________________; and

WHEREAS, the sale of the Property to Sussex County Habitat for Humanity will promote the general welfare by creating low/moderate income housing; and

WHEREAS, Sussex County Habitat for Humanity has agreed to rehabilitate or construct new residential housing at the Property and sell the property to an individual/family that qualifies, under applicable guidelines, to purchase a low/moderate income housing unit in the Township of Wantage, for a price, and upon such terms as set by the applicable guidelines; and

WHEREAS, Sussex County Habitat for Humanity has agreed to return the net sale proceeds to the Affordable Housing Trust and to the Township of Wantage as partial consideration for the transfer of the Property to Sussex County Habitat for Humanity;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Committee of the Township of Wantage, in the County of Sussex and State of New Jersey as follows:

  1. The Mayor and Township Committee of the Township of Wantage shall sell to Sussex County Habitat for Humanity the parcel known and designated as Block 117 Lot 17 on the Official Tax Map of the Township of Wantage, commonly known as 392 Route 565 for a consideration of One Dollar ($1.00), subject to the terms and conditions of the proposed Contract.
  2. The Mayor and Acting Municipal Clerk are hereby authorized to execute any and all documents necessary to transfer title to the Property known and designated as Block 117 Lot 17 to Sussex County Habitat for Humanity to construct housing for low or moderate income persons or families or for handicap persons pursuant to N.J.S.A. 40A:12-21(l).
  3. The transfer of title to Sussex County Habitat for Humanity shall be subject to an automatic reverter of ownership of the Property to the Township of Wantage in the event Sussex County Habitat for Humanity ceases to exist, dissolves, and/or becomes insolvent before the actual conveyance of the Property to a qualifying family and/or person, or if the Sussex County Habitat for Humanity fails to commence and complete construction within twelve (12) months of the date of the conveyance, and continuously pursue the construction of the improvements.

The within ordinance shall take effect in the time and manner provided by law and, if particular, the procedure delineated in the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.

NOTICE is hereby given that the above ordinance was introduced and passed upon first reading at a meeting of the Mayor and Committee of the Township of Wantage, in the County of Sussex, New Jersey, held on the 14th day of December 2023. It will be further considered for final passage after public hearing at a meeting of the Mayor and Committee to be held in the Municipal Building, 888 Route 23 South, in the Township of Wantage, on December 28, 2023 at 7:00 P.M., and during the preceding week copies of the ordinance will be made available at the Clerk's office in the Municipal Building to members of the general public.
